Terms and conditions for purchases from Calistria

§ 1 General framework
​ (1) The following terms and conditions govern all sales transactions between Calistria and its customers in a binding manner.
(2) All prices are stated in euros and are exclusive of VAT and shipping costs, unless expressly indicated otherwise.
(3) The purchase of goods from Calistria requires that the customer has reached the age of 18.
(4) Calistria reserves the right to amend or correct content, product descriptions, and pricing information at any time, provided there is an objective justification.
(5) In the event of ambiguities or disputes, an objective and customer-oriented solution will be pursued.
(6) Customers are obligated to comply with the legal provisions applicable at the respective place of destination and use, and shall indemnify Calistria against any third- party claims arising from unlawful use.
(7) The applicable statutory provisions shall apply in all cases.
§ 2 Scope
(1) These General Terms and Conditions apply to all purchase agreements with Calistria in the version valid at the time the contract is concluded.
(2) Should any provision of these Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
§ 3 Right of withdrawal
(1) The provisions of the Austrian Distance and Off-Premises Contracts Act (Fern- und Auswärtsgeschäfte-Gesetz – FAGG) shall apply.
(2) The right of withdrawal expires prematurely in contracts for the delivery of live plants where, due to their nature, they are liable to deteriorate rapidly or where their condition and quality depend significantly on time, temperature, transport, or handling (§ 18 para 1 no 4 FAGG).
(3) In particular, withdrawal is excluded if the delivered plants are no longer in a saleable condition after handover or have been adversely affected by external factors such as temperature, humidity, light, improper handling, storage, or comparable circumstances.
§ 4 Delivery conditions
(1) Delivery shall be made to the address specified by the buyer during the ordering process.
(2) In the case of consumers, the risk of accidental loss or accidental deterioration of the goods passes to the buyer upon handover of the delivery.
(3) From that point onward, the buyer bears all risks arising from the specific nature of live plants.
§ 5 Payment modalities
(1) Calistria offers various secure payment methods in the online shop.
(2) If advance payment is selected, shipment will take place only after full receipt of payment.
(3) Payments via PayPal are subject to an additional fee of 3.4% of the purchase price.
(4) Payments via SOFORT bank transfer are subject to an additional charge of 0.9% of the purchase price.
(5) Payments made by credit or debit card, Google Pay, or Apple Pay are subject to a fee of 1.9% of the transaction amount plus €0.30 per transaction.
(6) Manual card entry is subject to a fee of 2.3% of the transaction amount plus €0.30 per transaction.
(7) In the event of chargebacks, additional fees may apply and shall be borne by the buyer.
§ 6 Warranty
(1) The statutory warranty provisions shall apply.
(2) In the case of live plants, the warranty relates exclusively to the condition of the goods at the time of handover to the buyer.
(3) No warranty is provided for rooting success, development, vitality, yield, or any other changes occurring after handover, nor for damage resulting from transport, repotting, site selection, irrigation, fertilisation, climatic influences, or comparable external circumstances.
(4) Natural characteristics, cultivar-specific traits, and biologically inherent changes in live plants do not constitute defects.
§ 7 Transport damage
(1) Any obvious transport damage should, where possible, be reported immediately to the carrier and notified to Calistria without undue delay.
(2) Failure to make such a report does not affect existing statutory warranty rights but may facilitate the enforcement of claims against transport service providers or insurers.
§ 8 Disclaimer of liability
(1) Calistria is not Liable for anything after the Clones Leave the Facility
§ 9 Retention of title
(1) Until full payment has been made, the delivered goods remain the property of Calistria.
§ 10 Liability clause

Unless otherwise provided in these Terms and Conditions, the statutory liability provisions shall apply.
§ 11 Data protection regulations

Personal data is processed exclusively in accordance with applicable legal provisions, treated confidentially, and used solely for internal purposes. The separate privacy policy shall apply additionally.
§ 12 Legal basis and place of jurisdiction

Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction, to the extent legally permissible, shall be the registered office of Calistria.
§ 13 Youth Protection
Age Verification
(1) The sale of age-restricted items is carried out exclusively to persons of legal age.
(2) To ensure compliance with youth protection regulations, identity and age verification may be conducted.
(3) Delivery of the goods shall take place only after successful age verification and exclusively to the
§ 14 Final Provisions
The ornamental plants offered by us are intended exclusively for botanical use. Continuous exposure to light of at least 18 hours per day, whether artificial or natural, is required to prevent the formation of flowers and fruiting bodies. Should a purchaser intend to use one of our plants to produce narcotic substances, this would entail legal consequences under the Austrian Narcotic Substances Act (Suchtmittelgesetz).
If our sales personnel become aware of such intentions, we are legally obligated to refuse the sale or withdraw from an existing contract.
By concluding the purchase agreement, the buyer undertakes not to use the acquired ornamental plants for unlawful activities.
Our products are sold exclusively to persons who are at least 18 years of age.
